Terms of Service

1. Definitions

• “Focus’d Media Studios,” “we,” “our,” or “us” refers to the business providing website design, branding, graphic design, SEO, and digital marketing services.
• “Client,” “you,” or “your” refers to any individual, business, or organisation using our services.
• “Services” refers to all products and services offered by Focus’d Media Studios, including but not limited to website design, branding, SEO, and marketing solutions.

2. Scope of Services

Focus’d Media Studios provides digital marketing, branding, web design, and related services. The scope of each project will be defined in a separate service agreement, proposal, or contract.

3. Payment Terms

• All services require a signed proposal and an upfront deposit before commencement.
• Payment schedules vary by project and will be outlined in the agreed proposal.
• Late payments may result in service suspension, delayed project timelines, or additional fees.
• All prices are exclusive of GST unless stated otherwise.

4. Client Responsibilities

• Clients must provide all necessary content, approvals, and assets required for project completion in a timely manner.
• Delays in providing required materials may affect the project timeline.
• Clients must ensure that any provided content (text, images, videos) complies with copyright and trademark laws.

5. Intellectual Property & Copyright

• Upon final payment, clients receive full ownership of completed website designs, branding, and other deliverables, unless otherwise stated.
• Focus’d Media Studios retains the right to showcase completed projects in portfolios and promotional materials.
• Any third-party materials used (stock images, licensed fonts, software) remain the property of their respective owners.

6. Revisions & Approval

• Revisions are included as per the project agreement. Additional revisions beyond the agreed scope may incur extra charges.
• Clients are responsible for reviewing and approving all work before launch or publication.
• Once a project is marked as complete, any further changes will be treated as new work.

7. Website Hosting & Maintenance

• Website maintenance and hosting are optional services offered separately.
• Clients opting for external hosting providers are responsible for their own security, backups, and technical support.

8. Refunds & Cancellations

• Deposits are non-refundable once work has commenced.
• If a project is cancelled by the client after commencement, a pro-rata fee will be charged based on work completed.
• If Focus’d Media Studios must cancel a project due to unforeseen circumstances, a fair refund or alternative arrangement will be offered.

9. Limitation of Liability

• Focus’d Media Studios is not liable for indirect, incidental, or consequential damages arising from the use of our services.
• We are not responsible for losses due to website downtime, third-party software failures, or cyber incidents beyond our control.

10. Confidentiality

• Any confidential information shared between the client and Focus’d Media Studios will be kept private and not disclosed to third parties unless required by law.

11. Termination of Services

• Focus’d Media Studios reserves the right to terminate services if the client breaches these terms, engages in unlawful activities, or fails to make timely payments.
• Clients may terminate ongoing services with written notice and any outstanding payments settled.

12. Governing Law

These Terms of Service are governed by the laws of Queensland, Australia. Any disputes will be handled under the jurisdiction of Queensland courts.

13. Updates to These Terms

Focus’d Media Studios reserves the right to modify these terms at any time. Changes will be posted on this page, and continued use of our services constitutes acceptance of the updated terms.
